Three premises in Kuching suspected of selling fake chocolate malt drinks raided

KUCHING, March 17: The Ministry of Domestic Trade and Cost of Living (KPDN) Sarawak has raided three premises here for reportedly selling counterfeit nutritional chocolate malt beverages.

KPDN Sarawak director Matthew Dominic Barin said 255 units of the drink worth RM9,814.95 were seized.

The raid was conducted by a team of KPDN Sarawak enforcement officers following a complaint from the product trademark owner.


Matthew said the case would be investigated under Section 102(1)(c) of the Trademark Act 2019, which is to have in custody or control, for the purpose of trading of any goods on which a registered trademark is used incorrectly.

If found guilty, a fine of up to RM 10,000 for each counterfeit item used with the wrong registered trademark may be imposed or imprisonment for up to three years, or both.

For a second or subsequent offence, a fine not exceeding RM 20,000 for every counterfeit item that is used with the wrong registered trademark may be imposed or imprisonment for a period not exceeding five years, or both.

Therefore, KPDN Sarawak wishes to remind and warn all parties not to sell goods without the approval or consent of the owner of the registered trademarks. — DayakDaily
