Indonesian youth jailed 12 months for criminal trespass, assaulting house owner

KUCHING, Oct 13: The Magistrate’s Court here sentenced an Indonesian man to 12 months’ imprisonment for criminal trespass into a private house and voluntarily causing hurt to the house owner.

Rudi Irawan, 20, pleaded guilty to two charges and was sentenced by Magistrate Mohd Syukri Mokhtar to six months’ imprisonment for each charge, with the imprisonment terms to run consecutively.

Rudi was charged with committing criminal trespass into the house at Tabuan Desa, at about 4.30pm on Oct 6, 2020, and voluntarily caused hurt by punching the house owner’s face while the said owner was screaming for help after seeing the accused at his house.

The accused was charged under Section 448 of the Penal Code for criminal trespassing, which carries an imprisonment term which may extend to six months or a maximum fine of RM3,000, or both.

He was also charged under Section 323 of the Penal Code for voluntarily causing hurt to the house owner which carries an imprisonment term which may extend to one year or a maximum fine of RM2,000, or both.
