KUCHING, March 11: An Indonesian man was today sent to jail for a total of 100 years and ordered to be caned 50 times for raping his eldest daughter since 2015 when she was not even 10 years old.
The accused, 32, was slapped with a total of five charges in two Sessions Courts, and he pleaded guilty to all five charges, which were framed under Section 376B of the Penal Code for committing incest rape.
At Sessions Court 1, Judge Mohd Taufik Mohd Yusoff sentenced him to imprisonment for 20 years and 10 strokes of rotan for each of the two charges against him.
The imprisonment term is to start from the date of arrest and to run concurrently.
For these two charges, he was alleged to have raped his daughter at their house in a village in Bau, on Feb 20, 2019, at about 10.30pm and again on March 3, 2019, at about 3pm.
In Sessions Court 3, Judge Jason Juga meted out 20 years’ jail and 10 strokes of the rotan for each of the three charges against him.
The imprisonment term is to run consecutively.
However, Jason also ordered the imprisonment term to run consecutively with the sentence of the other court. This means Sujiman would be in jail for 80 years (20 years plus 60 years).
For the three charges filed at Sessions Court 3, he was alleged to have raped his daughter at their house on March 2015, June 2016 and June 2018.
Section 376B of the Penal Code carries imprisonment of not less than 10 years and not more than 30 years and whipping.
According to the facts of the case, it was a medical officer in Bau who lodged the police report when the victim was brought to the clinic for medical treatment. It was discovered that the victim had been sexually violated by her biological father without the knowledge of the victim’s mother.
The accused took advantage of the victim whenever there was nobody at home, and the victim would be blackmailed by her father whenever she tried to defend herself. — DayakDaily
