Immigration, labour autonomy non-negotiable, Sarawak has right to deny non-compliant operations

KUCHING, Nov 19: Sarawak has absolute authority to deny the operation of any individual, entity, or company within its borders if they fail to adhere to the laws established by the Sarawak government.

In stating this, Sarawak Minister of Tourism, Creative Industry and Performing Arts (MTCP) Dato Sri Abdul Karim Rahman Hamzah said Sarawak has immigration autonomy which grants the State government exclusive authority to regulate and control entry into the State, ensuring the safety, welfare, and interests of its people.

He also said Sarawak holds exclusive authority over labour matters under the Sarawak Labour Ordinance (Chapter 76), whereby all employers must obtain approval from the Sarawak government before hiring non-resident workers.

These rights, safeguarded by the Federal Constitution, Malaysia Agreement 1963 (MA63), and the Intergovernmental Committee (IGC) Report, are essential for Sarawak to protect its interests and maintain autonomy within Malaysia.

“At the same time, it is our collective responsibility to strictly enforce relevant laws. Any company or worker found violating Sarawak’s laws will face action, including the rejection or revocation of work permits.

“This applies to all entities operating in Sarawak. Compliance with Sarawak’s laws is a fundamental requirement that must not be questioned, as no one is above the law,” he said when presenting his ministerial winding-up speech in the Sarawak Legislative Assembly (DUS) sitting here today. — DayakDaily
