KUCHING, Nov 19: A 72-year-old farmer pleaded guilty in the Sessions Court today to charges of causing death without intent after accidentally shooting his friend with an unlicensed shotgun three years ago.
The accused, Nudui Simop, entered the plea after the amended charges were read to him by a court interpreter before Judge Iris Awen Jon.
In the first amended charge, Nudui was accused of causing the death of his 64-year-old friend by unintentionally shooting him with a shotgun.
The charge falls under Section 304A of the Penal Code, which carries a maximum penalty of two years’ imprisonment, a fine, or both.
The second amended charge was filed under Section 8(a) of the Arms Act 1960, for possessing an unlicensed shotgun. If convicted, the offense is punishable by up to seven years in prison, a fine not exceeding RM10,000, or both.
Both offenses were committed at Kampung Giam, Padawan, at around 12pm on August 27, 2022.
During the proceedings, Deputy Public Prosecutor Ruvinasini Pandian proposed a new mention date, citing the unavailability of key evidence.
She also argued against offering bail, highlighting the severity of the charges, public interest, and the risk of the accused fleeing.
However, Judge Iris Awen granted bail of RM10,000 without deposit, with two local sureties.
The court set Dec 5 as the next mention date to allow the prosecution to prepare the necessary evidence before sentencing.
