MIRI, Oct 8: A developer here has been ordered by the Sarawak Housing Purchaser Claims Tribunal to pay a home buyer a total of RM86,989.14 for late delivery of a condominium unit.
Tribunal President Dato Maznah Dasmi, directed the developer to pay the amount for late delivery of his claimant, Chung Siew Sang, for the RM700,000 property.
The developer had been ordered by Maznah to make payment within 45 days after receiving the letter of award, during Thursday’s hearing assisted by Robert Elone Sireng and Simon Woon Ta Meng.
She revealed that based on a sale and purchase agreement signed by the buyer on January 25, 2016, the developer exceeded the deadline to deliver his condominium unit by 36 months (from the date of the agreement was signed).
The buyer was supposed to have received the unit from the developer on January 25, 2019.
“The developer has delayed 622 days to deliver the house to the buyer,” said Maznah.
Failing to comply, the developer would be fined not exceeding RM5,000 or a jail tern not exceeding two years or both under Section 53(1)of the Housing Development (Control and Licensing) Ordinance 2013. — DayakDaily
