Court fines man RM5,000 for damaging ATM machine in Siburan

KUCHING, July 1: The Magistrate’s Court here has fined a man RM5,000 to a charge of breaking the screen of an ATM machine when he could not withdraw RM100.

Julio Patrick Dayey, 37, pleaded guilty to the charge framed under Section 427 of the Penal Code.

Section 427 of the Penal Code carries a jail term between one year and five years or a fine, or both upon conviction.

Magistrate Zaiton Anuar accepted his guilty plea and convicted him as charged, fining him RM5,000 or in default to 10 months’ imprisonment.

He was charged for committing mischief on an ATM machine by breaking its screen at a bank in Siburan, at about 12.02am on June 26.

His act caused a loss of about RM8,550.

According to the brief facts of the case, the staff of the said bank received a call from customer informing him that an ATM machine had been damaged by an unknown individual.

Upon investigation, it was found that the accused had punched through the screen of the ATM, breaking it in the process.

His act was recorded on close-circuit television cameras.

Prosecuting Officer Inspector Merylene Lindan Andrew Mang prosecuted while the accused was unrepresented by counsel. — DayakDaily
