KUCHING, March 4: A 34-year-old man was sentenced to a total of 24 months’ imprisonment by the Magistrate’s Court today after pleading guilty to assaulting and threatening to kill his wife when she refused his request for sex.
The accused admitted to two charges before Magistrate Mason Jaro Lenya Barayan.
He was first charged under Section 323 of the Penal Code, read together with Section 326A, for voluntarily causing hurt to his 31-year-old wife by punching her in the face. The second charge, under Section 506 of the same Code, was for criminal intimidation after he threatened to kill her.
The offences were committed at the couple’s home along Jalan Arang at about 11.30pm on Feb 27.
The court sentenced him to 12 months’ jail for each offence and ordered the sentences to run consecutively, resulting in a total of 24 months’ imprisonment.
According to the facts of the case, the couple were in their bedroom on the night of the incident when the accused initiated intimacy. Despite the woman declining, he became upset and allegedly tried to force himself on her. A struggle broke out when she resisted and kicked him away.
The accused then struck her twice in the face and allegedly threatened to kill her and her family if she continued to refuse his demand to have a third child.
The victim suffered injuries to her left ear and finger. Fearing for her safety and that of her family, she lodged a police report and sought treatment at a hospital. The accused was arrested on the same day.
The prosecution was conducted by Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan, while the accused was unrepresented. — DayakDaily
