Unemployed man sentenced to 5 years’ jail, 10 cane strokes for drug charge

KUCHING, Sept 17: The Sessions Court here sentenced a jobless man to 5 years’ jail and 10 strokes of the cane for possessing methamphetamine.

Ricky Nelson Ungking was arrested with five others in Sept 2019. All of them pleaded not guilty to charges of drug possession.


However, Ricky, 30, pleaded guilty to the drug possession charge here today. He said the bag and drugs found by the police belonged to him, while the police did not discover any drugs on the other five people.

Therefore, Sessions Court Judge Steve Ritikos convicted the accused as charged and discharged and acquitted the other five accused.

The judge sentenced Ricky to 5 years’ jail and 10 strokes of the cane.

He was charged with possessing 36.64 grammes of methamphetamine at a house along Jalan Kuching-Serian, at about 8pm on Sept 17, 2019.

He was charged under Section 12(2) of the Dangerous Drugs Act 1952 which is punishable under Section 39A(2) of the same Act and read together with Section 34 of the Penal Code, which carries life imprisonment or an imprisonment term of not less than five years and whipping of not less than 10 strokes.
