KUCHING, April 14: Two ‘apam balik’ vendors were fined RM1,400 each or face five months’ imprisonment in default after they pleaded guilty to assaulting another trader following a misunderstanding last month.
Magistrate Mason Jaro Lenya Barayan handed down the sentence against Dzul Mizal Asley Shah Abdullah, 25, and Samsul Wahed, 37, after they admitted to the charge under Section 323 of the Penal Code, read together with Section 34 of the same code.
The provision carries a maximum sentence of one year in jail, a fine of up to RM2,000, or both upon conviction.
According to the charge, the two men, acting together, were accused of intentionally causing injury to a 48-year-old trader by repeatedly punching him in the face. The incident occurred at about 2.50pm on March 26, in front of a coffee shop along Jalan Gambier.
Case facts revealed that the victim lodged a police report claiming the duo had assaulted him during a heated altercation at the location. As a result of the incident, the victim suffered bruises and pain on the back of his head.
Police investigations, aided by CCTV footage from the area, confirmed that both accused had punched the victim several times.
A medical report further revealed that the victim sustained soft tissue injuries and traumatic epistaxis (nosebleed) from the assault.
It was understood that the altercation stemmed from a misunderstanding among the traders, which escalated into a physical confrontation.
Neither of the accused was represented by legal counsel during the proceedings. — DayakDaily
