KUCHING, Sept 20: The Sessions Court here today cleared and freed a male technician from the charge of sexually assaulting his niece in 2021.
Session Court Judge Iris Awen Jon today found that the prosecution had failed to prove a prima facie case against the 42-year-old accused at the end of the prosecution’s case today.
The accused was released without having to be called to defend himself.
According to the charge, the accused is charged under Section 14 (a) of the Sexual Offenses Against Children Act 2017 which carries imprisonment of up to 20 years and caning, if convicted.
He is alleged to have committed the offense around January 2021 to May 2021 in a house in Petra Jaya.
Based on the facts of the case, on the day of the incident, he allegedly committed physical sexual assault on the four-year-old victim by touching the victim’s private part.
A total of six witnesses were called throughout the trial of the case which ended on July 25.
The prosecution of the case was handled by Deputy Public Prosecutor, Ruvinasini Pandian, while the accused was represented by lawyer, Abdul Rahman Mohd Hazmi. — DayakDaily
