Six teens sent to Henry Gurney School over involvement in fatal Batu Kawah hotel incident

KUCHING, Dec 7: The Magistrates Court here today ordered six teenage boys, who pleaded guilty to charges related to the death of a 51-year-old man, to be sent to Henry Gurney School.

The incident occurred in a hotel in Batu Kawah on October 30, with the court decision following an examination of facts and statements, along with a review of the moral and social reports submitted by the Department of Social Welfare today.

Magistrate Mason Jaro Lenya Barayan directed four juvenile offenders aged between 15 and 17 to stay at the school until they reach the age of 21. Simultaneously, Magistrate Zubaidah Sharkawi ordered two young offenders, each aged 18, to be sent to the school for three years.

The rulings came after the teenagers admitted guilt in the Magistrates’ Court on November 10, 2023, under Section 304(b) of the Penal Code read together with Section 34 of the Penal Code, carrying a maximum penalty of 10 years imprisonment, a fine, or both if convicted.

According to the charges, the group was accused of jointly committing the offence on October 30, 2023, between 12.30am and 1am on the staircase of a hotel in MJC Batu Kawah.

The case details revealed that the victim was assaulted by several young men on the day of the incident.

The victim sustained injuries and was taken to Sarawak General Hospital for treatment, where he was confirmed dead on November 1, 2023.

Police reports were filed, leading to the arrests of all the accused between October 31 and November 2, 2023.

None of the accused were represented by lawyers.

To date, 11 individuals, including the six juvenile offenders, have been brought to court in connection with this case. Hartley Tuntun Jerah, 33, convicted under Section 304(b) of the Penal Code read together with Section 34 of the Penal Code for causing the victim’s death unintentionally, received a five-year prison sentence on November 16, 2023. Ayu Abdullah, 25, charged under Section 109 of the Penal Code read together with Section 304(b) of the Penal Code for conspiring with her husband, Ashley Austin Chin, 25, to cause the victim’s death, was also sentenced to five years in prison on November 16, 2023.

Additionally, Ashley and Albert Chin Quan Yan, 22, each received a four-year prison sentence from the Magistrates Court on November 10, 2023, after pleading guilty to charges under Section 304(b) of the Penal Code. — DayakDaily
