Man jailed six months, fined RM1,000 for assaulting wife over divorce request

KUCHING, Sept 10: A 23-year-old man was sentenced to six months in prison and fined RM1,000 by the Magistrate’s Court today for slapping and kicking his wife after she requested a divorce.

Mohamad Hairee Basiree pleaded guilty to the charge under Section 323 of the Penal Code, read together with Section 326A of the same code, before Magistrate Ling Hui Chuan.

The court also ruled that Hairee, who was unrepresented, would face an additional one-month jail term if he failed to pay the fine.

According to the charge sheet, Hairee was accused of intentionally causing injury to his 35-year-old wife during an incident at a rented room in Taman Sri Wangi, Jalan Matang, on the night of Sept 7, 2024, around 10pm.

Case details revealed that Hairee became enraged and assaulted his wife by slapping her on the forehead and kicking her right side, leaving her bruised and in pain.

The victim lodged a police report following the incident, leading to Hairee’s arrest the same day.

Police investigations found that the altercation was triggered by the victim’s request for a divorce, which Hairee opposed. This disagreement escalated into a physical altercation where Hairee slapped her and kicked her in the waist.
