KUCHING, July 18: A man has been sentenced to one month’s imprisonment and fined RM4,000 by the Magistrate’s Court for threatening to kill and choking his former wife when she refused his demand to reconcile.
Raden Mohamad Ambia Masli, 35, pleaded guilty to the two charges framed before Magistrate Syarifah Fatimah Azura Wan Ali.
The magistrate sentenced the accused to one month’s imprisonment and fined him RM4,000 or in default to seven months’ imprisonment.
The accused was charged under Section 506 of the Penal Code of committing a criminal threat by threatening to cause death to his 26-year-old ex-wife.
The second charge was under Section 323 of the Penal Code, read together with Section 326A of the same Code, for pressing and choking his ex-wife’s neck.
Both offences were committed at the accused’s residence in Taman Suria Jaya Matang, at about 4.30pm on July 12.
According to the brief facts of the case, the victim went to the accused’s house after the accused asked her to deliver milk for their two-year-old child.
In an angry tone, the accused then instructed the victim to enter the house to discuss matters concerning their child.
However, while in the living room, the accused pressured the victim to reconcile with him, citing concerns for the child’s future.
The victim refused, and this caused the accused to become furious, uttering terrifying threats such as “I want you dead because you don’t understand our child”.
Subsequently, the accused forcefully pressed the back of the victim’s neck and choked her with both hands, causing her to collapse on the floor and struggle to breathe.
Feeling frightened, unsafe and threatened by the accused’s actions, the victim filed a police report, leading to the accused’s arrest.
Prosecuting Officer ASP Hisyam Junaidi prosecuted while the accused was unrepresented by counsel. — DayakDaily
