Man jailed 12 months for slapping, threatening sister

KUCHING, Sept 18: An unemployed man who caused grievous hurt and criminally intimidating his sister over personal matters over a week ago, was sentenced to 12 months’ jail by the Magistrate’s Court, here, today.

Magistrate Mohd Syukri Mokhtar meted out the sentence on Rahmat Saiful Jaya, 33, from Kampung Tabuan Tengah, after he pleaded guilty to both charges.

The accused was charged under Section 323 of the Penal Code that was read together with Section 326A of the same Act, for voluntarily causing grievous hurt to his younger sister by slapping her at a house at Lorong 13, Bintawa Ulu, at 1.45pm on Sept 7.


He was also charged under Section 506 of the same Code for criminally intimidating his sister by threatening to kill her on the same day and at the same time and place.

For the charge of causing hurt, Rahmat was sentenced to eight months’ jail, while for the criminal intimidation charge, he was sentenced to four months’ imprisonment.

The court ordered him to serve the sentences concurrently from the date of his arrest on Sept 13, which meant that the accused only needed to be in jail for eight months.

According to the facts of the case, the accused had not been home since Aug 31, 2019, which led to the victim bringing the man’s wife to the house of his girlfriend to bring him back.

The accused got angry at his sister for her action and slapped the victim, while threatening to kill her.

Investigating officer Nelson Ensit prosecuted, while the accused is unrepresented by counsel. — DayakDaily
