Man gets hit with fine, jail time after going ballistic, assaulting own family members because of toothache

KUCHING, Nov 24: In a fit of rage fueled by a toothache, a local man inflicted harm on his family members when he refused advice to seek medical attention at a hospital.

His actions resulted in him being fined RM3,600 or sentenced to 11 months in prison by the Magistrate’s Court here today.

Erwan Jan Mohamad, 43, pled guilty to three charges read by the interpreter before Magistrate Mason Jaro Lenya Barayan.


For the first and second charges under Section 323 of the Penal Code for intentionally causing injury by punching his 39-year-old sister’s face and his 20-year-old nephew, he was fined RM1,000 or sentenced to three months in prison for the first charge, and RM1,600 or six months in prison for the second charge.

The third charge, under Section 427 of the Penal Code, accused Erwan of committing mischief by damaging his father’s bedroom door, causing a loss of RM300.

For this offense, he was fined RM1,000 or sentenced to two months in prison.

Erwan committed the offenses in a residence in Taman Desa Wira, Batu Kawah, at around 7 pm on Nov 11.

During the incident, the accused requested his sister (the complainant) to massage his body as he was feeling unwell.

The complainant advised him to go to the hospital for a health examination as he had been fainting frequently lately.

However, this suggestion triggered the accused to go into a fit of rage, punching the complainant on the head, back, and right hand.

When the complainant’s son attempted to calm the accused down, he too was struck on the shoulder and slapped.

In addition to the assault, Erwan also caused damage to his father’s bedroom door, incurring a loss of RM300.

It was understood that the accused admitted to his actions, citing an inability to endure the toothache, along with experiencing headaches and pain in the left cheek. — DayakDaily
