KUCHING, Feb 20: A man was sentenced to three months’ imprisonment and fined RM1,000 by the Magistrate’s Court here today after pleading guilty to stealing a smartphone.
Magistrate Zubaidah Sharkawi ordered Irrizary Toni, 31, to serve an additional month in jail if he fails to pay the fine.
He was charged with committing the offense at around 10.40am at a shop in a shopping centre on Stutong Road here on Feb 9, 2024.
The charge was made under Section 380 of the Penal Code, which carries a penalty of imprisonment of up to 10 years and a fine upon conviction.
According to the facts, the owner of the smartphone (the complainant) realised that his phone, which was placed on a table, had gone missing. The complainant then checked closed-circuit television (CCTV) footage which showed a man taking the smartphone.
A police report was filed, leading to the arrest of the accused on Feb 12, 2024. Further investigations revealed that the accused took the complainant’s smartphone and sold it to an unknown person.
Moreover, examination results also showed images of the accused entering the premises where the incident occurred, which were captured on CCTV footage.
Furthermore, the complainant also recognised the accused’s face because prior to the incident, they had met and spoken with each other.
The prosecution was conducted by ASP Rogayah Rosli, while the accused was not represented by a lawyer. — DayakDaily
