Man gets 28 years’ jail, 10 strokes of rotan for rape, possessing offensive weapon, gang robbery

Both accused being escorted by a police officer.

KUCHING, Dec 3: A man was sentenced to a total of 28 years’ imprisonment and 10 strokes of the rotan after he pleaded guilty to raping a girl, possessing an offensive weapon and committing gang robbery.

Mohamad Apendi Shah was slapped with three charges in two different cases.


In the first charge, he was alleged under Paragraph 376(2)(b) of the Penal Code to have raped a 17-year-old girl on May 16, 2018, at about 1.30pm at a house in Kenyalang Park.

For the second charge, he was alleged under Subsection 6(1) of the Corrosive and Explosive Substance and Offences Weapon Act 1958 to have in his possession a knife without lawful purpose on May 16, 2018, at about 1.30pm at an area in Kenyalang Park.

Sessions Court Judge Mohd Taufik sentenced the accused to 15 years’ jail and 5 strokes of the rotan for the first charge, and 5 years’ jail for the second charge.

In another case, Mohamad Apendi was charged under Section 395 of the Penal Code, to be read together with Section 397 of the Penal Code, for committing gang robbery with Mohd Norsaifuddin on May 16, 2018, at about 1.30pm at a house in Kenyalang Park.

They were both sentenced to 8 years in jail and 5 strokes of the rotan.

Mohd Norsaifuddin was also slapped with two other charges.

In the first charge, he was alleged under Subsection 8(1) of the Corrosive and Explosive Substance and Offences Weapon Act 1958 and punishable under Subsection 6(1) of the same Act for being in the company of Mohamad Apendi, who was carrying an offensive weapon.

In the second charge, he was alleged under Section 414 of the Penal Code for disposing a stolen property on May 16, 2018, at 3pm in Jalan Padungan Utara.

Judge Mohd Taufik sentenced Mohd Norsaifuddin to an imprisonment term of 5 years for the first charge and 3 years’ jail for the second charge.

He ordered that the jail term of both accused to run concurrently and from the date of their arrests.

Hence, Mohamad Apendi will be in jail for 15 years and be given 10 strokes of the rotan. Mohd Norsaifuddin, on the other hand, will be in jail for 8 years and receive 5 strokes of the rotan. — DayakDaily
