KUCHING, Feb 21: The Magistrate’s Court here fined a man RM8,000 for committing mischief on a luxury car as the latter believed it was the same car which almost hit the accused’s son in an earlier incident.
The accused, 33, pleaded guilty to the charge framed before Magistrate Zaiton Anuar and was sentenced to a fine of RM8,000 or in default to 12 months’ imprisonment.
He was charged under Section 427 of the Penal Code, read together with Section 34 of the same Code.
According to the brief facts of the case, on Feb 17, at about 4.20am, the complainant saw from his office window that an unknown man was vandalising his Mercedes Benz and breaking his car window.
Coincidentally, a police team was patrolling the area and had witnessed the act of the accused and arrested him.
The complainant then checked on his car and found that the windscreen, both front side mirrors, passenger seat mirror and a front lamp were broken, and there were also dents on the car door and bonnet. The loss was estimated to be about RM50,000.
The police investigation revealed that the accused intentionally acted that way because he held grudges against the victim as the victim had allegedly nearly hit the accused and his friend’s children while they were cycling near MJC earlier on.
