Lorry driver gets two years in jail for criminal breach of trust, stealing gas cylinders

KUCHING, April 15: A lorry driver of a gas store has been sentenced to imprisonment of two years, one stroke of whipping and a fine of RM3,000 after he was charged with stealing gas cylinders belonging to the company and criminal breach of trust.

Hafizudin Sakeran pled guilty to the two charges.


Sessions Court Judge Jason Juga accepted his guilty plea. For the first charge, Judge Jason Juga sentenced him to imprisonment of two years, 1 stroke of whipping and a fine of RM2,000 or in default to two months imprisonment. For the second charge, Judge Jason Juga sentenced him to one year of imprisonment and a fine of RM1,000 or in default to one month imprisonment.

Judge Jason Juga also ordered the imprisonment term to run concurrently.

For the first charge, as a lorry driver of PB Mart Sdn Bhd, Hafizudin committed breach of trust when handling cash monies of RM1,152 belonging to the said company, at about 9.30am on April 22, 2020.

He was charged under Section 408 of the Penal Code, which carries an imprisonment term between one year and 14 years, whipping and liable to a fine upon conviction.

For the second charge, he committed theft by stealing four units of gas cylinder amounting to RM640 belonging to the company, at about 9.30am on April 22, 2020.

He was charged under Section 381 of the Penal Code, which carries a maximum imprisonment term of seven years and a fine, upon conviction.
