KUCHING, Mar 1: A 26-year-old unemployed man pleaded guilty at the Sessions Court here today to raping his 13-year-old girlfriend.
Judge Mohd Taufik Mohd Yusoff accepted the guilty plea and sentenced the accused, Evander Backy Mohine, to 7 years’ jail and 7 strokes of the rotan.
Evander was charged under Section 376(1) of the Penal Code, which carries a maximum jail term of 20 years and liable to whipping, for raping his underage girlfriend on Jan 28 this year at about 7.30am inside a room at a house in Bau District.
According to the facts of the case, it was a doctor of Bau Hospital Emergency Department who lodged the police report.
The victim was brought to the hospital on Jan 28 at about 9.50pm for medical examination. Upon examination, the complainant found that there were scratch marks on the victim’s hand and some kiss marks on her neck. The victim then admitted she had sexual intercourse with the accused several times.
Police investigation revealed that the accused had known the victim since mid-November 2017 via WeChat and they became lovers.
Deputy Public Prosecutor Syarifah Fatimah Azura Wan Ali prosecuted, while the accused was not represented. — DayakDaily
