Jobless man gets 23 years’ jail, 9 strokes of rotan for armed robbery charges

KUCHING, May 10: An unemployed man was sentenced to a total of 23 years’ jail and 9 strokes of the rotan for armed robberies by the Sessions Courts, here, today.

Accused Nur Affizzul Mahdi, 24, from Petra Jaya, was actually slapped with four armed robbery charges in three Sessions Courts, but one judge fixed May 14 for sentencing.

Before Sessions Court Judge Marutin Pagan, Nur Affizzul was charged under Section 392/397 of the Penal Code for robbing a grocery store at Taman Lee Ling with a parang on March 31, 2019, at about 4.30am. He robbed the store of RM500.

For this charge, he was jailed 8 years and 5 strokes of the rotan after pleading guilty.

The DPP for this case was Nor Azhari Yusof, while the accused was unrepresented.

Two charges were filed against Nur Affizzul before Sessions Court Judge Dayang Ellyn Narisa Abang Ahmad.

For the first charge, he was charged under Section 395 read together with Section 397 of the Penal Code with committing gang robbery with Owen Ken Norton, 21, using a deadly weapon — kerambit — at a 24-hour Mart in Batu 4, Jalan Penrissen, at about 4.16am on August 29 last year.

They allegedly ran off with RM960 and two boxes of cigarettes belonging to the mart.

For this offence, which he pleaded guilty, he was sentenced to 10 years’ jail and 3 strokes of the rotan.

As for the second charge, he was charged under Section 6(1) of the Corrosive and Explosive Substances and Offensive Weapon Act 1958 for possessing a kerambit.

For this offence, he was sentenced to imprisonment of 5 years and 1 stroke of the rotan.

Judge Dayang Ellyn Narisa ordered the imprisonment term for these two charges to run concurrently but consecutively with the imprisonment term passed by Judge Marutin Pagan.

DPP Ruthra Raj prosecuted, while the accused was not represented.

Before Sessions Court Judge Mohd Taufik Mohd Yusoff, Nur Affizzul pleaded guilty to committing armed robbery at a grocery store in Matang Jaya on August 16, 2018, at about 4am. He robbed the store of RM700.

He was charged under Section 392 of the Penal Code read together with Section 397 of the same Code, but Judge Mohd Taufik wanted DPP Nurfadzlin Mahmad Zulhasnan to provide the court with the particulars of the cases that the accused was previously charged and sentenced.

Judge Mohd Taufik then fixed May 14 for sentencing. — DayakDaily
