Jobless man gets 15 months’ jail, RM1,000 fine for punching, strangling his wife

KUCHING, Jan 23: A 39-year-old unemployed man was today sentenced to 15 months’ jail and fined RM1,000 in default two months’ jail for hurting his wife.

Accused Lamaja Lambor from Sibu pleaded guilty before Magistrate Mohd Syukri Mokhtar.

He was charged under Section 323 of the Penal Code, read together with Section 326A of the same Code, that on Jan 16, 2019, at about 8pm, at a rented house at Taman Durande Emas, he voluntarily caused hurt by punching and strangling his wife.

Section 323 states that the accused shall be punished with imprisonment of up to one year or a fine of up to RM2,000 or both upon conviction, while Section 326A states that whoever during their subsistence of a valid marriage causes hurt to his spouse and commits an offence under Sections 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

According to the facts of the case, it was the 28-year-old victim who lodged the police report on Jan 16, and the accused was caught the next day.
