KUCHING, Dec 9: An Indonesian woman was sentenced to a total jail term of eight months on charges of illegally entering Malaysia and being involved in illegal online gambling activities.
Nelayana Yanisubuana, 21, was charged with two charges in the Sessions Court and the Magistrate’s Court respectively.
She was charged with entering Malaysia without any valid documents at a premises in Taman BDC, at about 1.55pm on November 25, 2021 under Section 6(1)(c) of the Immigration Act 1959/1963 and punishable under Section 6(3) of the same Act.
Sessions Court Judge Dayang Ellyn Narisa Abang Ahmad sentenced her to a jail term of four months, with effect from today and ordered the accused to be referred to the Immigration Department after she had served her jail sentence.
For the second charge, the accused was charged with using an online gambling machine, which is a smartphone, at a premises in Taman BDC, at about 1.55pm on November 25, 2021.
She was charged under Section 4B(a) of the Common Gaming Houses Act 1953.
Magistrate Syarifah Fatimah Azura Wan Ali sentenced her to imprisonment of four months, with effect from the date of her arrest on November 25, 2021.
According to the brief facts of the case, a Kuching Criminal Investigation Department (CID) police team raided the said premises as it was suspected to be used for illegal online gambling activities.
Upon investigation by the police, it was found that the accused who worked as the shop assistant did not possess a legal document to enter Malaysia. — DayakDaily
