KUCHING, Sept 21: The Sessions Court here sentenced a former army personnel to 11 years’ imprisonment and 2 strokes of the cane for raping and impregnating a 15-year-old girl.
Rod Rogers Guntor, 26, from Kampung Grogo, faced two charges under Section 376(2)(d) of the Penal Code, which carries imprisonment of up to 20 years and with whipping, upon conviction.
Sessions Court Judge Maris Agan found the accused guilty of both charges after a full trial and found that the defendant had failed to raise beyond reasonable doubt.
The judge sentenced the accused to 11 years’ imprisonment and a stroke of the cane for each charge and ordered the imprisonment term to run concurrently with effect from today.
The accused was charged with raping the victim in a room in Kampung Grogo, between 2am to 4am on December 6, 2019.
He was also charged with raping the same victim in a hotel room in Bau on December 29, 2019.
According to the brief facts of the case, a doctor lodged a police report after he found that the victim was pregnant, and she was underaged.
A DNA test also revealed that the baby was fathered by the accused.
It was found that both the victim and the accused did not know each other before the first rape took place.
