Federal gov’t upholds Sabah’s 40 pct revenue share, moves to start immediate talks

KUCHING, Nov 11: The federal government has decided not to appeal the Kota Kinabalu High Court’s ruling affirming Sabah’s entitlement to 40 per cent of the state’s revenue and will instead intiate immediate negotiations with the Sabah government.

The announcement was made following a Special Cabinet Meeting held today to discuss the High Court judgment, which was issued in response to a Judicial Review Application filed by the Sabah Law Society (SLS) against the Malaysia government.

The Attorney General’s Department confirmed that the federal government respects the principle of the Special Grant, which is enshrined under the Federal Constitution.

“The federal government has decided not to file an appeal against the court’s decision on the 40 per cent revenue entitlement,” read the statement.

During the meeting, the Attorney General also provided legal advice on perceived defects in the Court’s Reasons for Judgment. These included allegations that both the federal and Sabah governments had allegedly abused power and violated constitutional duties, a matter reportedly spanning back to 1974.

Furthermore, the court had stated that the post-2021 review process was unlawful, irrational, procedurally flawed, and disproportionate.

“While the federal government has chosen not to contest Sabah’s 40 per cent revenue entitlement, it will pursue an appeal regarding these specific legal deficiencies cited in the judgment,” the Attorney General Chamber said. — DayakDaily
