‘Devolution is not separation, respecting MA63 means respecting the constitution’ — Senator

KUCHING, Feb 23: Senator Rita Sarimah Patrick Insol recently told Parliament that respecting the Malaysia Agreement 1963 (MA63) is a constitutional obligation, not a political concession, stressing that Sabah and Sarawak’s rights are embedded in the Federal Constitution.

Speaking during the debate on the motion of thanks for the Royal Address, she said MA63 forms the legal foundation of Malaysia and outlines the division of powers between the federal government and the Borneo States.

Rita highlighted key constitutional safeguards, including separate immigration powers for Sabah and Sarawak, State authority over land and local government and protections under Article 161E requiring consent from the Yang di-Pertua Negeri for amendments affecting State rights. She also referred to provisions on special grants under Article 112D.

She added that certain rights had been eroded over time but noted recent efforts to restore the spirit of MA63, including the 2022 amendment to Article 1(2) of the Federal Constitution and ongoing negotiations through the MA63 Special Committee.

“Respecting MA63 means respecting the constitution itself. Ignoring it undermines the foundation of Malaysia.

“Sabah and Sarawak are founding partners, not just territories. Upholding autonomy commitments reflects justice and fidelity to the nation’s founding agreement.

“Devolution is not separation,” she said, adding that restoring rights consistent with MA63 strengthens the federation rather than weakens it. — DayakDaily
