KUCHING, July 14: While the issuance of land titles falls under the Department of Land and Survey, which is under the Ministry of Natural Resources and Urban Development (MUDeNR), the Minister of Housing has the authority to take action against developers of Taman Kalien.
In stating this, special assistant to Democratic Action Party (DAP) chairman Chong Chieng Jen, Michael Kong Feng Nian, was referring to the delay in issuing land titles to Taman Kalien house owners for over ten years.
He explained that the Standard Sale and Purchase Agreement, regulated under the Housing Development (Control and Licensing) Ordinance 2013, includes a clause that obligates developers to secure separate issue documents at their own cost and promptly.
This provision, he said, was enacted by the Sarawak Legislative Assembly (DUN) to hold developers accountable for the protection of homebuyers.
“Furthermore, Section 27(1) of the Housing Development (Control and Licensing) Ordinance 2013 empowers the Minister (Minister of Public Health, Housing and Local Government Sarawak, Dato Sri Dr Sim Kui Hian) to take action against developers, even on his own initiative, if they are conducting their business in a manner detrimental to the interests of purchasers.
“This indicates that (Dr Sim) has the authority and jurisdiction to address the issue if there is a genuine willingness to assist the people,” he said in a statement today.
He was responding to Sarawak United Peoples’ Party (SUPP) Women chief Kho Teck Wan’s recent statement that shot down DAP Sarawak men—Chong and his subordinate, Sim Kiat Leng—for pointing fingers at Dr Sim for the Taman Kalien issue. — DayakDaily
