Businessman acquitted of illegal possession of cosmetics

KUCHING, Nov 8: The Sessions Court here has today discharged and acquitted a businessman on a charge of illegally possessing 13 cosmetics and beauty products.

The prosecution had called four witnesses to establish its case against the accused.


However, having considered the evidence adduced on a maximum evaluation basis, Judge Mohd Taufik Mohd Yusoff found that the prosecution has failed to prove a prima facie case on the charge preferred.

Therefore, Judge Mohd Taufik discharged and acquitted the accused without calling for his defence.

Sim Peng Chuan was found in possession of 13 types and sizes of baby powder and thus contravened Regulation 18A(1) of the Control of Drugs and Cosmetics Regulation 1984.

He was charged under 18A(15) of the same regulation and punishable under Section 12(1) of the Sale and Drugs Act 1952.— DayakDaily
