KUCHING, Dec 9: BCS Aviation (Sarawak) Sdn Bhd has denied allegations of engaging in unauthorised aircraft refuelling activities and announced plans to seek legal advice to challenge the charges brought by the Malaysian Aviation Commission (Mavcom).
The allegations, outlined in a Mavcom press release dated Dec 5, 2024, accused the company of 60 offences that allegedly took place at the North Pan Hangar, Kuching International Airport, between July 29 and August 18, 2019.
In a press statement today, the company’s director Dato Sri Robert Song Tung Wei categorically denied conducting any aircraft refuelling during the stated period, asserting instead that it was involved solely in supplying aircraft fuel to Hornbill Skyways Sdn Bhd, a Sarawak government subsidiary.
“For the supply of the aircraft fuel, BCS Aviation (Sarawak) Sdn Bhd have obtained all the necessary permits from the Malaysia Airports Holdings Bhd.
“BCS Aviation (Sarawak) Sdn Bhd has also complied with the provisions and regulations under the Petroleum Development Act, 1974 in relation to the storage, supply and delivery of the said aircraft fuel to the North Pan Hanger at Kuching International Airport.
“Therefore, the allegation contained in Mavcom’s said press release contains false information which is defamatory of both of us and has thus caused damage to our reputations,” he said.
Following this, Song said the company shall be seeking legal advice on possible legal action against Mavcom and its executive chairman for the defamatory statement made.
“Meanwhile, we shall contest all the 60 charges proffered against us as it is our strong belief that we are innocent and have done nothing wrong in law as we did not carry out any act of aircraft refuelling at that time or at any other time,” he added.
The statement also criticised the penalties associated with the charges, noting that the total amount involved in the 30 instances of fuel supply was only RM36,385.30.
In contrast, the charges carry a potential maximum penalty of RM60 million and 90 years of imprisonment, which BCS Aviation described as “grossly disproportionate.”
Song further said given the present Sarawak Government’s push to develop the oil and gas downstream activities in Sarawak, BCS Aviation (Sarawak) Sdn Bhd as a pioneering Sarawak local company venturing into the supply of aircraft fuel, has invested heavily and participated in the State government’s policy to achieve the government’s vision to harness energy resources for the sustainable development and progress in Sarawak.
“However, regrettably, the unwarranted act of Mavcom and its executive chairman has an effect to suppress and dampen the company’s growth in this sector.
“To the best of our knowledge, this is the first instance throughout the country and in the history of Mavcom where it has engaged in such a massive number of charges against one company on this misconceived ground,” he emphasised. — DayakDaily
