KUCHING, Oct 28: The Sessions Court here sentenced a construction worker to eight years of jail and two strokes of the rotan for raping his underage girlfriend.
Wandi Karni, 26, pleaded guilty to the charge framed.
Sessions Court Judge Jason Juga accepted his guilty plea.
The accused in his mitigation said that he wanted to marry the said underage girlfriend. However, DPP Nurfadzlin Mahmad Zulhasnan argued the accused could not use the intention of marrying the victim as an excuse to escape punishment under the law.
Wandi was found to have committed rape on his 15-year-old 11-month girlfriend at a workers’ quarters in Kampung Sungai Lumut, Jalan Sultan Tengah, at about 12.30am on October 11.
He was charged under Section 376(1) of the Penal Code, which carries an imprisonment term of up to twenty years and liable to whipping, upon conviction.
A medical officer with the Kampung Buntal health clinic lodged a police report after the girlfriend visited the clinic on October 18. She had suffered bleeding from a fall and claimed to be pregnant.
However, the results of a urine test by the girlfriend came back negative. — DayakDaily
