KUCHING, September 27: The Magistrate’s Court here sentenced a man to 6 months’ imprisonment and a stroke of the cane for dishonestly using the debit card of a Netherlands citizen to buy cigarettes.
Fitri Awliya Mohamad, 23, pleaded guilty before Magistrate Zaiton Anuar to the charge framed under Section 403 of the Penal Code, which provides for a jail term of between 6 months and 5 years, and with whipping, upon conviction.
He was charged with misappropriating a debit card belonging to a 31-year-old Netherlands national to buy cigarettes at a 24-hour store in Jalan Satok, at about 2.44am on September 11, 2022.
According to the brief facts of the case, the victim lost his wallet at an entertainment centre in Jalan Wayang on September 11 and subsequently lodged a police report.
On September 13, the victim lodged a police report again after he received notification from his bank informing that his debit card had been used to make purchases at a 24-hour store at Jalan Satok.
The accused was arrested on September 22.
A police investigation found that the accused had used the victim’s debit card to purchase a box of Dunhill cigarettes costing RM17.40.
Inspector Merylene Lindan Andrew Mang prosecuted while the accused was unrepresented by counsel. — DayakDaily
