KUCHING, June 16: A 29-year-old man was sentenced to a fine of RM2,500 for the charge of insulting the modesty of another man by recording a video of him while he was using the toilet in a mall.
Raychai Darak, 29, pleaded guilty to the charge framed under Section 509 of the Penal Code, which carries a maximum imprisonment term of up to five years, or a fine, or both, upon conviction.
Magistrate Zaiton Anuar convicted him as charged and sentenced him to a fine of RM2,500 or in default 5 months’ imprisonment.
He was found guilty of insulting the modesty of a 19-year-old man by recording a video of the victim while the victim was using the toilet in a mall located along Jalan Wan Alwi, at about 1.19pm on June 12, 2023.
According to the brief facts of the case, while the victim was using the toilet, he saw a hand holding a mobile phone and recording a video of him.
The victim then lodged a complaint with a security guard, and the guard detained the accused and handed him over to the police.
During the police investigation, the accused admitted to recording a video, and an 18-second clip of the victim was found on the accused’s phone.
He also admitted he was attracted to men.
Prosecuting Officer Inspector Merylene Lindan Andrew Mang prosecuted the case, while the accused was unrepresented by counsel. — DayakDaily
