Factory worker sentenced to a day in jail, fined RM3,500 for groping woman

KUCHING, Feb 22: The Magistrate’s Court here has sentenced a factory worker to a jail term of one day and fine of RM3,500 to a charge of outraging the modesty of a woman.

Erwan Effindi, 27, pleaded guilty to the charge framed under Section 354 of the Penal Code.

Magistrate Syarifah Fatimah Azura Wan Ali accepted his guilty plea and convicted him as charged.

The accused allegedly using criminal force with the intention to outrage the modesty of a 27-year-old girl by touching her breast without her consent at an office unit in Matang Ria Commercial Centre, at about 4.50pm on Feb 16, 2022.

Section 354 of the Penal Code carries a maximum imprisonment term of 10 years, a fine or whipping or with any two of the punishments, upon conviction.

According to the brief facts of the case, the accused went to the said office to return the key to the entrance of the main entrance of the building. He then touched the breasts of the victim without her consent.

The victim then lodged a police report for further action.
