82-year-old Datuk remanded for raping 13-year-old

KUCHING: There were four rape and molest cases involving victims who are minors, where the suspected perpetrators are someone who should have been their protectors.

Sinchew Daily has reported four cases across Sarawak in Miri, Sibu, Kuching and Sri Aman, where minor victims have been abused by their adult relatives and teacher.

In Miri, a prominent 82-year-old Malay businessman who has the title of ‘Datuk’ was remanded yesterday for the alleged rape of a 13-year-old girl.

The mother of the victim said the victim did not come back home on Sept 10.

The victim came back only the next day, looking different, causing the mother to suspect rape and subsequently make the police report.

The suspect, though aged 82, was reported to look much younger than his age.

Meanwhile, in Sri Aman, a father aged 44, was sentenced to 54 years of imprisonment and a total of 12 strokes of the cane for incestuous rape in 2015.

His sentence would be carried out concurrently, landing him 26 years in prison.

He was convicted under Section 376B(1) of the Penal Code for raping his daughter who was 17 then.

The rape happened twice on April 15, 2015. The first rape occurred in the morning from 6am to 11.59 am and in the evening of the same day, from 6.30 pm until the next day 6.30am.

A police report was made on April 20, 2015.

Section 376B(1) of the Penal Code states that, “Whoever commits incest shall be punished with imprisonment for a term of not less than six years and not more than 20 years and shall also be liable to whipping”.

In Sibu, a grandfather and an uncle had been refused bail and continued to be remanded at the Sibu Prison for performing indecent acts towards their seven-year-old blood relative.

The 26-year-old uncle was charged with four counts of child sexual offences for outrage of modesty on the seven-year-old victim which happened in May, June, July and August at the longhouse in Durin where they are staying.

The fifth offence involved him showing a sex video to the child victim in May and August.

He will be charged under the Sexual Offences against Children Act 2017 which was just passed early this year.

Meanwhile, the 53-year-old grandfather who was just released after 12 years of imprisonment for raping his own daughter (who is also the seven-year-old victim’s aunt), was charged with the same offences as his 26-year-old son.

In Kuching, a 55-year-old teacher yesterday appealed against the decision sentencing him to five years’ imprisonment for molesting his 11-year-old student.

He was sentenced under Penal Code 354 which deals with assault or use of criminal force on a person with intent to outrage modesty.

The mother of the young victim said her child has been sexually molested by the teacher since Primary Three.
